Collection and processing of personal data

We treat your personal data with care and as permitted by law. We collect and process your personal data for the purpose of providing and managing your mortgage loan, preventing and combating fraud, having the loans provided by Hyra Hypotheken audited and to prevent us from doing business with criminals and terrorists, for example. We also use your personal data to conduct statistical and scientific research. If you do not want to give us your personal data, we will not be able to grant you a mortgage loan or manage it.

We do the processing of personal data pursuant to the performance of the agreement. We also need to process your personal data to comply with our legal obligations. We keep your personal data for as long as is necessary according to our internal policies and applicable laws and regulations.

What personal data do we collect from you?

• We collect the following personal data from you in these ways:

• Data you provide to us, whether through your intermediary or not:
• Contact details; Identification details including BSN;
• Financial details including IBAN;
• Occupation and income details;
• Housing characteristics;
• Additional relevant details;
• Are you married or living with a partner? If so, please provide the terms of your marriage or partnership;
• Your signature;
• A copy of your proof of identity;
• Details of the directors of the company;
• Details of the beneficial owner(s).

• Data we obtain through other sources:

• Data from the Central Credit Information System (BKR-CKI);
• The incident alert system of the Stichting Fraudebestrijding Hypotheken (SFH);
• Data from the Verification Information System (VIS);
• Possibly data from various registers (including the Central Insolvency Register and sanction lists);
• Data from the Land Registry;
• Data from the Chamber of Commerce;
• PEP register;
• LRS (national debt restructuring register);
• Data on Adverse Media.

With whom do we share your personal data?

If necessary, we share (part of) your personal data with the following (types of) parties:

• Bank;
• Administrator and/or trustee;
• Bureau Krediet Registratie;
• Bailiff;
• Investors of Hyra Hypotheken;
• Notary Public;
• Persons and parties to whom Hyra Hypotheken transfers the rights of the loan;
• Persons and parties with whom Hyra Hypotheken cooperates for your loan. Also outside the European Economic Area;
• Appraiser and broker;
• Intermediary;
• Yourself as a party concerned;
• Insurance company.

If we use processors in processing your personal data, we enter into a processor agreement with them.

In addition to sharing personal data with these individuals and parties, the law may require us to share data with, for example, the Tax Authorities or Justice, in the context of legal proceedings or with other government institutions.

What are your rights?

If you want to access, delete or transfer your personal data, you may do so under the ‘General Data Protection Regulation (AVG)’, the ‘AVG Implementation Act’ and the ‘Code of Conduct for Processing Personal Data by Financial Institutions’. For completeness all your rights in a row:

• Right of inspection – You have the right to request inspection (in principle free of charge) of (part of) the personal data we hold on you at any time.
• Right to be forgotten / data erasure – You have the right to have data we hold on you deleted. Upon your request, we will erase data, unless this is not possible due to exceptions in the law. We delete your data in the following situations:

• The personal data is no longer needed for the purpose for which it was collected;
• You withdraw the consent required for processing and there is no other legal basis for processing;
• You object to processing based on a legitimate interest, unless there are compelling legitimate grounds for the processing;
• The personal data has not been properly processed; and
• Where the data must be deleted because the law requires it.
• Right to restriction – You have the right to request us to restrict (in part) the processing of your personal data. If this request is found to be justified, your data, with except for its storage, will only be processed to the extent you consent.
• Right to rectification – If the information we hold about you is incorrect, we will amend this information immediately after you point it out to us.
• Right to object to legitimate interest – You have the right to object to the processing of your personal data on the basis of legitimate interest.
• Stop direct marketing – Do you no longer want to receive direct marketing material from us? Please inform us at marketing@hyrahypotheken.nl

• Right to data portability – You have the right to have data you have supplied as a digital file forwarded to other companies that need your data.

Please include in your request your address and contact details, your mortgage number and which right you wish to invoke. To verify your request and your identity, you may be asked to provide additional details or information.

Insofar as you have given your own consent to the processing of your personal data, you may withdraw your consent at any time. In the following cases, please contact us in writing at the above address:

• if you wish to correct, supplement or delete incorrect data;
• if you want us to process less data about you; or
• if you wish to object to the processing of your personal data.

In the following cases, we cannot approve your request:

• if the request is unfounded;
• if it is a request we are not legally required to comply with;
• if we need your personal data for the performance of the agreement we have with you; or
• if we have a legitimate interest in processing it.

Do you have a complaint?

Do you have a complaint about our processing of your personal data or do you have a complaint about our response to your request? If so, you can file a complaint with us and/or with the Personal Data Authority.

Security

Hyra Hypotheken takes appropriate technical and organisational measures to protect your personal data against:

• accidental or deliberate manipulation;
• loss;
• destruction;
• access by unauthorised persons; and other unlawful processing.

Our security measures are continuously improved in line with new security standards.

Changes

Hyra Hypotheken has the right to make changes to this Privacy Statement. We do not need to inform you of this in advance. If we make changes, you can find the amended version on this page of our website.
